HAi!CO User Terms & Conditions

Welcome and thank you for reviewing our HAi!CO User Terms and Conditions. CardSys Sdn. Bhd. (Company No. 407836-T) (“ CardSys”) provides you the capability to participate in CardSys’s loyalty management systems and programs (“Services”). This is established through CardSys’s mobile application (“Hai!CO”), providing you access to the Services offered by participating businesses (“Reward Partner”). When you sign up on Hai!CO you have the option to collect points (“Reward”) and redeem points (Redemption”) offered by participating Reward Partner.

By clicking “Sign Up” button yourself, you affirm that you understand this agreement and accept its terms, and accept the CardSys Privacy Policy, which is incorporated into and considered a part of this agreement. The CardSys Privacy Policy is available on HAi!CO website (URL: https://haiico.com/privacy-policy).

The services provided are subject to evolve and the nature of the services that CardSys provides may change periodically without prior notice. Any new features that augment or enhance the current Services, including the release of new tools and resources, shall be subject to these Terms and Conditions. Continued use of the Services after any such changes shall constitute your consent to such changes.

1) Acceptance of Terms of Service

By using Hai!CO in any way you are agreeing to comply with these Terms and Conditions and our Privacy Policy. HAi!CO is provided to partner and/or merchant upon agreement and sign-up of the HAi!CO program. By using HAi!CO you also understand and agree that CardSys is not responsible for any content posted in HAi!CO by participating businesses, and you, nonetheless, may be exposed to such materials. You agree to use HAi!CO at your own risk. You should periodically visit this page to review the current Terms of Use so you are aware of any revision to which you are bound.

You agree to the following account terms:

You are at least 18 years of age.
You are to provide accurate information when using HAi!CO including, but not limited to, information required to register with HAi!CO.
You must accurately represent yourself when using HAi!CO; other people, automated computer programs (“bots”), deceased individuals, or anything of the sort may not use HAi!CO and CardSys’s Services on your behalf.
You are not to access and use data not intended for you, such as logging into an account you are not authorized to access.
You are to legitimately use HAi!CO for your own use and enjoyment.
You are responsible for maintaining the security of your account and password. CardSys will not be liable for any loss or damage from your failure to comply with this security obligation.
You are responsible for all Content posted and activity that occurs under your account.
You may not use HAi!CO for any illegal, fraudulent, false, speculative, or unauthorized purposes not permitted by this Agreement. You must not violate any Federal or State laws when using HAi!CO.
You must not act maliciously or illegally against any participating businesses using HAi!CO.

Violation of any of the terms above will result in the termination of your Account.

2) Use of Service

You may access the Services if you agreed to HAi!CO User Terms and Conditions herein. You will use HAi!CO solely for your own enjoyment purposes. You are prohibited from modifying or reverse engineering any source code of HAi!CO.

Businesses participating and offering HAi!CO shall be responsible to display and advertise HAi!CO at their retail sites. Any rewards, incentives, deals, or promotions set by participating merchants through HAi!CO must be fulfilled by participating partners and/or merchants if properly redeemed by a customer. In order to interact with a participating business, you must download HAi!CO, located in the Google Play Store and Apple App Store. Once downloaded onto your mobile device, you are required to enter particular information about yourself for registration. You can review Rewards, redeem points (“Redemption”), promotions, deals, and other offers by opening HAi!CO on your mobile device.

When downloading HAi!CO you will be required to login personal information, such as, but not limit to, a valid email address, name, gender, mobile number and birth date to properly use HAi!CO. CardSys or Reward Partner may periodically send you emails or push notifications tied to promotions, special offers, rewards, or as a direct response to an inquiry on rejected purchase receipt submission from you.

CARDSYS AND THE BUSINESS PROVIDING YOU HAI!CO EXPRESSLY DISCLAIM ANY LIABILITY, AND WILL NOT BE LIABLE, FOR ANY LOSS OR DAMAGE INCURRED ON THE REWARD AND REDEMPTION OR AS A RESULT OF ANY INTERACTION BETWEEN YOU AND A REWARD PARTNER ACCESSIBLE HAI!CO. REWARD PARTNER SHALL SOLELY AND STRICTLY BE RESPONSIBLE AND LIABLE TO ALL POINTS REWARDED AND REDEEMED BY YOU. ALL MATTERS, INCLUDING BUT NOT LIMITED TO, REWARD, REDEMPTION, DELIVERY OF GOODS AND SERVICES, RETURNS, AND WARRANTIES, AND THE SECURITY OF THE PURCHASE TRANSACTIONS ENTERED INTO, ARE SOLELY AND STRICTLY BETWEEN YOU AND THE REWARD PARTNER.

3) Ownership of Data

All contents of HAi!CO and services are the property of CardSys, participating businesses, or advertisers. The compilation (i.e., the collection, arrangement, and assembly) of all content on HAi!CO are the exclusive property of CardSys. The website and contents of HAi!CO may not be copied, distributed, or transmitted in any way without the prior written consent of CardSys. You may not modify the content in any way, nor delete any copyright or trademark notice. Any information, ideas, suggestions, or communications sent by you through HAi!CO becomes the exclusive property of CardSys. Subject to the terms of the CardSys Privacy Policy, CardSys is entitled to use, reproduce, disclose, and distribute any information submitted for any purpose without restriction or compensation to you.

4) Termination of Service Usage

CardSys may terminate your rights to HAi!CO at any time at its sole discretion, without providing any explanation for such termination and without any liability or obligation to you. CardSys may terminate access if you violate any of the terms of this Agreement or any policy or procedure applicable to the use of HAi!CO that may be published by CardSys periodically. If your Services are terminated by CardSys for such violations, any Rewards or Redemption programs may be terminated in accordance with the terms of such Rewards or Redemption program. The disclaimers, and limitations of liabilities set forth in these User Terms shall survive any such termination.

5) Privacy

You understand that CardSys and HAi!CO reward Partners will collect information from you and that they may use such information for marketing and promotional purposes. Disclosures about how CardSys and Reward Partner use information about you are described in CardSys’s Privacy Policy. CardSys and each participating partners and/or merchant have agreed to operate in accordance with said CardSys Privacy Policy. Please carefully review this Privacy Policy before using HAi!CO, and before providing any Registration Information to CardSys.

6) Disclaimer of Warranties and Representations

HAI!CO AND MATERIALS ARE PROVIDED “AS IS,” “AS AVAILABLE,” “WITH ALL FAULTS,” AND WITHOUT ANY WARRANTY OF ANY KIND, EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMISSIBLE UNDER APPLICABLE LAW, CARDSYS AND ITS LICENSORS DISCLAIM ALL WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NONINFRINGEMENT. WITHOUT LIMITING THE FOREGOING, CARDSYS DOES NOT WARRANT THAT ACCESS TO HAI!CO, THE CARDSYS WEBSITE, OR CARDSYS PROGRAMS AND SERVICES WILL BE UNINTERRUPTED OR ERROR-FREE, OR THAT DEFECTS, IF ANY, WILL BE CORRECTED; NOR DOES CARDSYS MAKE ANY REPRESENTATIONS ABOUT THE ACCURACY, RELIABILITY, CURRENCY, QUALITY, COMPLETENESS, USEFULNESS, PERFORMANCE, SECURITY, LEGALITY OR SUITABILITY OF THE SERVICES, THE MATERIALS, OR THE MERCHANT PORTAL SITE. YOU EXPRESSLY AGREE THAT YOUR USE OF HAI!CO AND RELIANCE UPON HAI!CO, AND/OR CARDSYS MATERIALS IS AT YOUR SOLE RISK.

7) Limitations of Liability

To the maximum extent permitted by applicable law, CardSys is not liable to you for damages of any kind, including, without limitation, any punitive, exemplary, consequential, incidental, indirect, or special damages arising from or in connection with use of CardSys services and HAi!CO, whether under a theory of breach of contract, negligence, strict liability, malpractice, or otherwise, even if CardSys has been advised of the possibility of such damages

8) Indemnification

You agree to indemnify, hold harmless, and defend CardSys and its suppliers, officers, directors, employees, agents, affiliates, and subsidiaries, from and against any and all liability, loss, claim, damages, expense, or costs (including, but not limited, to attorneys’ fees), incurred in connection with your use of HAi!CO.

9) Miscellaneous

Any notice, request, demand, or other communication required or permitted hereunder shall be delivered in writing and shall be sent by courier service or mailed by registered or certified mail, transmitted by facsimile, or emailed, addressed to the other party. Notices to you shall be sent by such method to their listed physical address, facsimile number, or email address provided during the registration of HAi!CO.

This Agreement comprises the entire agreement between you and CardSys and supersedes all prior agreements between the parties regarding the subject matter contained herein. CardSys reserves the right to amend or modify these User Terms or impose new conditions at any time. Such amendments and modifications will be effective immediately upon giving you notice by any means including, but not limited to, posting on this site. Any waiver of any provision of the Agreements will be effective only if in writing and signed by CardSys.

10) Force Majeure

CardSys will not be held liable for any loss or damage suffered to HAi!CO as a direct result of cause beyond its control including an Act of God, accident, war, riot, lockout, strike, flood, fire, power failure, breakdown of plant or machinery, delay in transit, postal delay, terrorism, or any other unexpected or exceptional cause or circumstance.

11) Governing Law

This Agreement shall be subject to and construed in accordance with the laws in Malaysia, and the parties hereby submit to the exclusive jurisdiction of courts in Malaysia.

HAi!CO Reward Partner Terms & Conditions

Welcome and thank you for reviewing our HAi!CO Reward Partner Terms and Conditions. CardSys Sdn. Bhd. (Company No. 407836-T) (“ CardSys”) provides you the capability to participate in CardSys’s loyalty management systems and programs (“Services”). This is established through CardSys’s mobile application (“Hai!CO”), providing you access to the Services offered under the HAi!CO Client Portal and HAi!CO Merchant Application.

By clicking “Get Started” button yourself, you, an individual or entity (“Reward Partner” or “you”), affirm that you understand this agreement and accept its terms, and accept the CardSys Privacy Policy, which is incorporated into and considered a part of this agreement. The CardSys Privacy Policy is available on HAi!CO website (URL: https://haiico.com/privacy-policy). If you do not agree to all the terms as set forth hereafter, do not click “Get Started.”

By using Hai!CO and the Services in any way you are agreeing to comply with these Terms and Conditions and CardSys Privacy Policy. HAi!CO is provided to you upon agreement and sign-up of the HAi!CO program. By using HAi!CO you also understand and agree that CardSys is not responsible for any content posted in HAi!CO by participating businesses, and you, nonetheless, may be exposed to such materials. You agree to use HAi!CO at your own risk. You should periodically visit this page to review the current Terms of Use so you are aware of any revision to which you are bound.

You agree to the following account terms:

You are to provide accurate information when using HAi!CO including, but not limited to, information required to register with HAi!CO.

If you sign up on Hai!CO Premium Plan, which incurs a fee annually, you will have full access to the features available in the HAi!CO Client Portal and HAi!CO Merchant Application.
For Reward Partner under the Premium Plan, you shall be required to enter into an additional agreement and/or contract with CardSys, for one (1) year from the date of acceptance and renews
automatically for additional terms of one (1) year unless terminated under the provisions of the agreement and/or contract.
If you sign up on HAi!CO Standard Plan, which is free-of-charge, you will have a limited accessibility option to the HAi!CO Client Portal and HAi!CO Merchant Application.
For Reward Partner under the Standard Plan, your account shall be terminated if it has been inactive for more than three (3) consecutive months.
Reward Partner, at its own cost and time, is responsible for the designs, contents, descriptions and posting and/or uploading the materials into the Promotion, Push Notification and eVoucher modules. Any rewards, incentives, deals, vouchers, electronic vouchers or promotions set by Reward Partner in HAi!CO must be fulfilled if properly redeemed by a HAi!CO user or member. Any such HAi!CO related fulfillment shall be in compliance with all applicable laws and regulations; and the terms of this Terms and Conditions, and the terms of the Services.
You must not act maliciously or illegally against any participating businesses using HAi!CO.
You shall be solely responsible and liable for the consequences of your posting in HAi!CO. You shall take absolute responsibility and liability of these postings and that CardSys takes no responsibility and assumes no liability for any posting by you.
You agree to indemnify and hold harmless CardSys and its officers, directors, employees and agents, from and against any claims, suits, proceedings, disputes, demands, liabilities, damages, losses, cost and expenses, including, without limitation, reasonable legal and accounting fees (including cost of defense of claims, suits or proceedings brought by third parties), in any way related to (i) your access to or use of HAi!CO, (ii) your posting contents, or (iii) your breach of any of these Terms.

Violation of any of the terms above will result in the termination of your Account.

2) Use of Service

You may access the Services if you agreed to HAi!CO Reward Partner Terms and Conditions herein. You will use HAi!CO solely for loyalty program related transactions. You are prohibited from modifying or reverse engineering any source code of HAi!CO.

HAi!CO Reward Partner shall be responsible to display and advertise HAi!CO at their retail sites. Any rewards, incentives, deals, or promotions set by participating merchants and/or partner through HAi!CO must be fulfilled by participating partners and/or merchants if properly redeemed by a customer.

The logos, trademarks and other designations of HAi!CO is collectively referred to as the “Trademarks” of CardSys. Reward Partner may use Trademarks in its sales and marketing related to HAi!CO. Reward Partner agrees to follow any Trademark use guidelines provided by CardSys in writing. In no event shall Reward Partner use Trademarks in any defamatory or obscene manner or, as determined by CardSys in its reasonable discretion, in any manner likely to harm the CardSys’s reputation or goodwill. CardSys grants Reward Partner a non-exclusive, non-transferable license to use Trademarks solely to promote HAi!CO and other HAi!CO related events during the term as HAi!CO Reward Partner. Reward Partner will present to CardSys, for its prior approval, any item or material that uses or refers to Trademarks. Reward Partner shall not use Trademarks in advertisements or promotions that contain any reference to any entity that is not related to HAi!CO. Reward Partner consents to receive periodical advertisements, promotions, and marketing from CardSys about HAi!CO promotions. Reward Partner agrees to use HAi!CO information solely for the purposes of active promotions and as otherwise permitted herein, and will not sell, deliver, or otherwise transfer HAi!CO information to another except as permitted herein or unless required by the federal or applicable state laws of Malaysia.

3) Consent of Collection and Ownership of Data

CardSys and/or its third party provider must collect personal and transaction data related to the usage of HAi!CO made from Reward Partner with its users and/or members. To facilitate the collection of this data, CardSys may establish data and/or Uniform Resource Locators links, and:

(a) the Reward Partner, its employees, and/or appointed agents authorize CardSys and its third party providers to use the Reward Partner’s transaction data as contemplated by and in furtherance of the objectives of the usage of HAi!CO, including for determining, identifying and tracking Reward Partner, users and members activity;

(b) Reward Partner permits the monitoring, collection, use, disclosure and sharing of HAi!CO related personal and transaction data for the purpose of enabling the Services;

(c) Reward Partner consents to the access and processing of personal and transaction data collected from HAi!CO in connection with the Services, and acknowledges and agrees that CardSys may use such data for purposes of generating anonymous, aggregated, statistical models and compilations, trend analyses, program performance analyses, benchmarking, the development of case studies and for internal business purposes.
